Official Golden Ticket Giveaway Rules, Terms and Conditions

WHO CAN ENTER? This Giveaway is exclusively open to individuals aged 21 or above who have placed an order of at least $100 at www.zotterusa.com between July 7th and September 15th, 2024. Employees of Zotter Chocolates US LLC, their subsidiaries, affiliates, or any companies engaged in promoting the Giveaway, as well as the immediate family members (spouse, parents, siblings, and children) and those residing in the same household of such employees, are not permitted to enter.

WHO IS THE GIVEAWAY SPONSOR? Zotter Chocolates US LLC, located at 12551 New Brittany Blvd, Fort Myers, FL 33907, is the official sponsor of this Giveaway (hereafter referred to as the “Sponsor”).

HOW TO PARTICIPATE? From July 7th, 2024, any order placed on www.zotterusa.com with a value of $100 or more will automatically include one ticket for every $100 spent.
Mail-in Entry: To obtain an entry without making a purchase, please send us a postcard with hand printing your name, street address, city, state, and or postal code, telephone number, and complete e-mail address on a standard 4” x 6” postcard (with no outer envelope) and mail to: Zotter Chocolates US LLC, 12551 New Brittany Blvd, Fort Myers, FL 33907.

SELECTION OF WINNERS: Winners will be chosen from a pool of ticket coupons in a live draw, broadcasted via Facebook and YouTube on September 27th, 2024, at 6:00 p.m. EDT. The chances of winning are dependent on the total number of eligible entries received.

WHAT IS THE PRIZE? The winning participant will receive a travel voucher that covers airfare, a three-night hotel stay (two nights near the Zotter Chocolate Factory in Styria and one night in Vienna), transfers, and entrance fees for the Chocolate + Aperitif Tour and the Edible Zoo visit. In addition, the winner will be treated to a private tour with Julia Zotter. The flights included in the prize depart from the continental United States. The prizes cannot be transferred and must be accepted as given. Cash or other substitutions are not permitted unless provided by the Sponsor, who retains the right to replace the prize with another of equal or greater value if the original prize is unavailable for any reason, as determined solely by the Sponsor. The winner will be held responsible for any taxes and all other costs and expenses not explicitly mentioned above.

POTENTIAL WINNER’S RESPONSIBILITIES: Where legally permitted, the potential winner may be required to complete and return a Declaration and Release form and/or tax form W-9 within five (5) days of receiving notification. If a potential winner declines the prize, fails to comply with these Official Rules, or does not sign and return the required documents within the stipulated time period, an alternate winner will be chosen randomly from the remaining entries.

OTHER TERMS AND CONDITIONS YOU SHOULD BE AWARE OF: By entering the Giveaway, participants consent to abide by these Official Rules and the final decisions of the Sponsor. Unless otherwise prohibited by law, participants grant permission for their name, voice, city/state of residence, photograph, and/or likeness to be used for advertising, trade, or any other purposes in any media or format, present or future, without additional compensation, permission, or notification.

The Giveaway is bound by federal, state, and local laws and regulations and is invalid where prohibited by law. In case the operation, security, or administration of the Giveaway is compromised due to any reason, including but not limited to fraud, virus, or other technical issues, the Sponsor, at its sole discretion, may either: (a) halt the Giveaway to rectify the issue and then continue the Giveaway in a way that best aligns with the spirit of these Official Rules; or (b) randomly select the prize winner from the eligible entries received till the point of disruption.

Any person found to be interfering with the entry process or the operation of the Giveaway or violating these Official Rules may be subject to legal action. The Sponsor reserves the right to seek damages from such person to the fullest extent permitted by law. The failure by the Sponsor to enforce any term of these Official Rules shall not be considered a waiver of that provision. The Sponsor reserves the right to modify or cancel this promotion at any time and, in the event of cancellation, substitute another in its place.

By participating in the Giveaway, the participant agrees to release and indemnify the Sponsor, its parent and associated companies, and their respective officers, directors, employees, and agents (the “Released Parties”) from any claim or cause of action arising out of the participant’s involvement in the Giveaway or receipt or use of any prize. Participants waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

DISPUTE RESOLUTION: Unless otherwise prohibited, the participant agrees that any disputes, claims, and causes of action arising out of the Giveaway or any awarded prize will be resolved individually, without resort to any form of class action, and exclusively by the appropriate court in the State of Florida. All questions and issues related to the construction, validity, interpretation, and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Giveaway, will be governed by the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of Florida.
